According to Chinese law, if the notarization provided by the parties is formed outside the territory of China, the evidence shall be notarized by the notary office of the country. Or the evidence shall perform the certification procedures stipulated in the relevant treaties between China and the nation.


Evidence involving identity relationships formed outside the territory of  China, including legal documents such as power of attorney submitted by parties who have no domicile in China, should be certified by the notary office of the country and authenticated by the embassy or consular of China in that country. Or fulfill the certification procedures stipulated in the relevant treaties concluded between China and the host country.Therefore, if a civil lawsuit is involved in China, and there are foreign-related factors in the case, including foreign parties involved or evidence formed outside the territory, notarization and certification by embassies and consular are often required. In most foreign-related civil activities, the parties must also provide corresponding notarization documents, including natural person identification, legal person's business certification, no criminal certificate, marital status, affiliation, inheritance qualifications. Notarization and certification procedures of embassies and consular abroad are the most common matters in foreign-related civil cases.

A notary institution can be an authority or a person who holds a particular position under a country’s legal regulations and notarization system, which has the right to issue specific documents with proof of effectiveness, including notary offices, lawyers, courts, judges, captains.
