涉外公证
根据中国法律规定,当事人提供的公文书证在中华人民共和国领域外形成的,该证据应当经所在国公证机关证明,或者履行中华人民共和国与该所在国订立的有关条约中规定的证明手续。
中华人民共和国领域外形成的涉及身份关系的证据,包括在中国无住所的当事人提交的授权委托书等法律文件,应当经所在国公证机关证明,并经中华人民共和国驻该国使领馆认证,或者履行中华人民共和国与该所在国订立的有关条约中规定的证明手续。
因此,如果在中国境内涉及民事诉讼,而且案件存在涉外因素,包括涉及境外当事人,或存在域外形成的证据,都常常需要进行涉外公证和使领馆认证。在绝大多数涉外民事活动中,也都要求当事人提供相应的涉外公证文书,包括自然人身份证明或法人的营业证明,无犯罪记录,婚姻状况,隶属关系,以及遗产继承资格等等。公证和驻外使领馆的认证程序,是处理涉外民事法律关系最常见的事务。
